1. Acceptance of Terms

By accessing and using the Canadian Adventures website and services, you accept and agree to be bound by the terms and provision of this agreement. These Terms of Service govern your use of our website, booking platform, and outdoor adventure services. If you do not agree to abide by the above, please do not use this service.

2. Adventure Services Description

Canadian Adventures provides outdoor recreational activities including but not limited to hiking, mountain biking, skiing, snowboarding, kayaking, and wildlife watching tours throughout Canada. Our services include guided tours, equipment rental, safety instruction, and transportation to adventure locations. All activities are conducted by certified professionals with extensive wilderness experience.

We reserve the right to modify, suspend, or discontinue any aspect of our services at any time. Weather conditions, safety concerns, or unforeseen circumstances may require changes to scheduled activities or itineraries.

3. Booking and Payment Terms

All bookings must be made through our official website or authorized booking agents. Full payment is required at the time of booking unless otherwise specified. We accept major credit cards and bank transfers. Prices are subject to change without notice, but confirmed bookings will honor the original quoted price.

Group discounts and special offers are subject to availability and specific terms. Corporate bookings and large group reservations may require special arrangements and deposit schedules.

4. Cancellation and Refund Policy

Cancellations made more than 14 days before the scheduled activity date are eligible for a full refund minus a $50 processing fee. Cancellations made 7-14 days prior receive a 50% refund. Cancellations made less than 7 days before the activity date are non-refundable except in cases of severe weather or safety concerns as determined by our staff.

We reserve the right to cancel activities due to insufficient bookings, weather conditions, or safety concerns. In such cases, customers will receive a full refund or the option to reschedule to a later date.

5. Safety Requirements and Participant Responsibilities

All participants must complete a medical questionnaire and liability waiver before participating in any activities. Participants must be in reasonable physical condition appropriate for the chosen activity level. Age restrictions apply to certain activities, and minors must be accompanied by a parent or guardian.

Participants are required to follow all safety instructions provided by guides and wear appropriate safety equipment at all times. Failure to comply with safety requirements may result in removal from the activity without refund.

Canadian Adventures provides basic first aid coverage, but participants are responsible for their own comprehensive travel and medical insurance. We strongly recommend purchasing travel insurance that covers adventure activities.

6. Equipment and Personal Property

We provide all necessary safety equipment and specialized gear for activities. Participants are responsible for bringing appropriate clothing and personal items as specified in our packing lists. Any damage to provided equipment due to misuse or negligence will result in replacement charges.

Canadian Adventures is not responsible for loss, theft, or damage to personal property during activities. Participants are advised to leave valuables in secure locations and bring only essential items on adventures.

7. Limitation of Liability

Outdoor adventure activities involve inherent risks including but not limited to injury, illness, property damage, or death. By participating in our activities, you acknowledge these risks and agree that Canadian Adventures, its employees, guides, and partners shall not be liable for any injury, loss, or damage arising from participation in activities.

Our liability is limited to the amount paid for services. This limitation applies regardless of the cause of action, whether in contract, tort, negligence, or otherwise.

8. Photography and Media Rights

Participants consent to photography and video recording during activities for promotional and safety purposes. Canadian Adventures retains the right to use such media in marketing materials, websites, and social media without additional compensation. Participants may request to opt-out of photography by notifying staff before activities begin.

9. Environmental Responsibility

All participants must adhere to Leave No Trace principles and respect wildlife and natural environments. Activities are conducted with minimal environmental impact, and participants are expected to follow all environmental guidelines provided by guides.

Violation of environmental regulations or disrespectful behavior toward wildlife or natural areas may result in immediate removal from activities without refund.

10. Privacy and Data Protection

We collect and process personal information in accordance with our Privacy Policy and applicable Canadian privacy laws. Your personal information is used solely for booking purposes, safety requirements, and communication regarding your adventures.

We do not sell or share personal information with third parties except as necessary for service delivery or as required by law.

11. Intellectual Property

All content on the Canadian Adventures website, including text, images, logos, and design elements, is protected by copyright and trademark laws. Unauthorized use, reproduction, or distribution of our content is strictly prohibited.

12. Governing Law and Dispute Resolution

These terms are governed by the laws of Canada and the province of British Columbia. Any disputes arising from these terms or our services shall be resolved through binding arbitration in Vancouver, British Columbia, except where prohibited by law.

13. Changes to Terms

We reserve the right to modify these Terms of Service at any time. Updated terms will be posted on our website with the effective date. Continued use of our services after changes constitutes acceptance of the new terms.
